SunflowersHill Store Copyright Dispute Policy

In compliance with the Digital Millennium Copyright Act (DMCA), SunflowersHill Store has adopted the policy outlined below to address claims of copyright infringement. We reserve the right to (1) block access to or remove material that we believe in good faith to be copyrighted material illegally copied and distributed through our platform, and (2) terminate service to repeat offenders.

Use of the SunflowersHill Store services is subject to our Terms of Use, which incorporate this Copyright Dispute Policy. Any undefined terms in this policy will carry the meanings provided in the Terms of Use.

A. Procedure for Reporting Copyright Infringements

If you believe that content on or accessible through SunflowersHill Store infringes your copyright or the copyright of someone you are authorized to act on behalf of, please send a notice of copyright infringement to our Designated Agent. Include the following information:

(1) A physical or electronic signature of a person authorized to act on behalf of the copyright owner.

(2) Identification of the copyrighted work claimed to have been infringed, including its registration number, if available.

(3) Identification of the material that is claimed to be infringing, with sufficient detail to allow us to locate the material on our platform.

(4) Contact information of the notifier, including name, address, telephone number, and email address.

(5) A statement that the notifier has a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.

(6) A statement under penalty of perjury that the information provided in the notice is accurate and that the notifying party is authorized to act on behalf of the copyright owner.

B. Actions Taken Upon Receipt of a Valid Notice

Upon receiving a proper notice of copyright infringement, SunflowersHill Store will:

(1) Remove or disable access to the infringing material.

(2) Notify the content provider responsible for the allegedly infringing material that the material has been removed or access has been disabled.

(3) Terminate the accounts of repeat infringers, as appropriate.

C. Procedure for Submitting a Counter-Notice

If you, as a content provider, believe that material removed or disabled due to a copyright claim is not infringing or that you have the right to use such material, you may send a counter-notice to the Designated Agent. Your counter-notice must include the following information:

(1) A physical or electronic signature of the content provider.

(2) Identification of the material that was removed or disabled and the location where it appeared before being removed or disabled.

(3) A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification.

(4) Your name, address, telephone number, and email address, along with a statement that you consent to the jurisdiction of the Federal Court for the judicial district where your address is located, or, if your address is outside the United States, for any judicial district where SunflowersHill Store is located, and that you will accept service of process from the person who submitted the original infringement claim.

Upon receipt of a counter-notice, SunflowersHill Store may send a copy to the original complaining party, informing them that the removed material may be restored or access re-enabled within 10 to 14 business days, unless the copyright owner files an action seeking a court order against the content provider.

D. Penalties for Misrepresentation

Under Section 512(f) of the DMCA, any person who knowingly misrepresents that material or activity is infringing may be subject to liability for damages, including court costs and attorney’s fees. SunflowersHill Store takes such misrepresentations seriously and will act accordingly.
